Consent(Required) I agree to Content Release terms.
I herein represent that I own all intellectual property rights to content ("Content") that I am contributing for use in the Shaka Documentary working title, "Shaka, A Story of Aloha" project (the “Project”) and in consideration of my contributed Content to the Project, and without any further consideration from ID8, a Hawai’i 501(C)(3) nonprofit organization (the “Producer”), I hereby grant permission for Producer to utilize my Content including but not limited to my appearance if I appear in the Content, in any and all manner and media and all rights of every kind and character whatsoever in perpetuity in and to my performance, appearance, name and/or voice and the results and proceeds thereof (the “Performance”) in connection with the Project.Use of Content. I hereby authorize Producer, it’s agents and assignees to: use the Content (including but not limited to film, digital, video, tape, audio or otherwise); to edit the same at its sole discretion and to include it with the performance of others and with sound effects, special effects and music; to incorporate same into the Project; and to use and to license worldwide in any manner or media whatsoever existing or yet to be invented, including without limitation unrestricted use of the Content and my Performance, name, likeness, voice, biographic or other information concerning me in connection with the Project including but not limited to publicity and promotional, advertising and/or sales purposes. I acknowledge that the Producer owns all rights to the Project, including but not limited to results and proceeds of the Project.Indemnification, Waiver & Release. I represent that I own rights to the Content, thus hereby agree to indemnify, hold harmless and defend Producer, and its past, present and future Board, officers, employees, agents, and assigns for any and all liability that may result from use of the Content. Further, I waive, release, and discharge the Producer, and its past, present and future Board, officers, employees, agents, and assigns from any and all claims, demands, actions, judgments, injunctions, orders, directives, penalties, assessments, liens, liabilities, losses, damages, costs, and expenses (including attorneys’ fees), arising or resulting from or caused by my making and/or confirming any representations and/or any misstatement or inaccuracy relating thereto and/or causes of action for any Injuries/Damages, known or unknown, related to, arising from, or traceable either directly or indirectly to my contribution of Content, participation in the Project and/or the use of my Performance.
